David Freiheit warns inaccurate reporting on Charlie Kirk's murder case could 'poison the jury pool', fuel conspiracy theories, and impact the trial's fairness.

David Freiheit, a former lawyer and legal commentator, has told RT that inaccurate media reporting on the defense team's statements in Charlie Kirk's murder case poses a real risk of 'poisoning the jury' and affecting the trial. Earlier this week, several outlets reported, citing lawyers for accused Tyler Robinson, that the US Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) could not conclusively link a bullet fragment from Kirk's body to a rifle found at the scene. According to Freiheit, some reports, such as by the Daily Mail, were inaccurate and misleading.

Freiheit believes the defense team aims to 'irritate anybody who believes that the defendant is guilty' and exclude damning evidence, including courtroom camera footage, which he called an abject disaster given the case's national and international importance. He emphasized that information fed to the media, whether accurate or not, could 'ferment conspiracy theories' and ultimately impact the trial, raising concerns about jury poisoning.

Freiheit also noted that key questions remain unanswered, such as whether others on social media had 'advance knowledge' of the attack and why a 'lapse' in campus security allowed the suspected assassin to take up a position on an unguarded roof. These issues, combined with media coverage, could complicate the case and jeopardize jury impartiality.
